Vicarious Liability: you can be responsible for not only your own members of staff but also the workers you place, you therefore need insurance in place which specifically covers vicarious liability. You may be deemed to be the employer of placements when they are on a temporary contract so you must make sure your cover will extend to cover them.
Misrepresentation: a client may allege that you have not carried out all the proper checks of a candidate prior to placing them, sometimes companies may claim for the re – recruitment costs and any other incurred expenses. There may be other errors such as sending a candidates application to their current employer or sending an opinion intended for internal colleagues only to the wrong person maybe the candidate or a client.
Drivers’ Negligence: you may be supplying professional drivers, if that driver causes damage to the end clients vehicles and they bring a claim against you, you would want your insurance to provide cover.
Liability cover: Employment status of temporary workers is unclear so if you are supplying care agency workers and they injure a patient that patient may bring a claim against your liability policy for their injury. You may also be deemed to be the joint or sole employer of temporary workers if that worker is injured then you may be brought into any claim action, you want to make sure your policy will respond if you are in this situation.
Fidelity Bonding: this provides cover for dishonest acts of any placed temporary staff.
Cyber cover: You will hold personal information on all of your candidates and clients and cyber is a huge emerging risk particularly to recruiters. Cyber risk insurance (also known as cyber liability insurance or cyber security insurance) is a type of liability insurance that protects you and your against cyber-crime, and the potential fallout of a cyber-crime attack.
When data is stolen or a computer system is breached, you could suffer in many ways. Not only would you have to pay the cost it would take to repair a system but, sometimes, hackers ask for a ransom to return the stolen data and this can cost thousands. The day-to-day running of your business may also be interrupted as a result of the cyber-crime, which would cause a loss of income that could be substantial. Further to this, your company could suffer from damage to your reputation if your customers perceive their data as vulnerable in your care. Not to mention any fines you may become liable to pay.
